Terms of Service

Last updated October 21, 2026

1. Agreement

These terms govern your use of Obramaestra, operated by DAVERIL DIGITAL TECHNOLOGIES OPC (“Obramaestra,” “we,” “us”). By creating an account or using the site, you agree to them. See the Privacy Policy for how we handle your data.

2. Who can use Obramaestra

You must be at least 18 years old and able to enter a binding contract. You're responsible for the accuracy of the information on your account and for keeping your login credentials secure — activity under your account is treated as yours.

3. What Obramaestra is

Obramaestra is a marketplace connecting independent artists with collectors. Artists are independent sellers, not employees, contractors, or agents of Obramaestra. We provide the listing, checkout, escrow, and payout infrastructure; we don't create, own, authenticate, or take title to any artwork sold through the platform.

4. Listing and selling artwork

By listing a piece, you represent that:

  • It's an original, one-of-a-kind physical work you made or otherwise have the legal right to sell — not a print, edition, or copy.
  • Its listing (photos, description, medium, dimensions, price) is accurate.
  • You own it free of any claim that would prevent you from selling it.

Once a piece sells it's marked sold and comes off the market. Your plan (Free, Basic, or Pro) sets how many active listings and AI room previews you get — see Pricing.

5. Fees and subscriptions

  • Obramaestra takes a 15% commission on the sale price of every completed order, on every plan. The full shipping fee the buyer pays goes to the artist — shipping isn't commissioned.
  • Basic and Pro are paid subscriptions, billed monthly or yearly: Basic is ₱199 a month or ₱1,990 a year, and Pro is ₱399 a month or ₱3,990 a year. Your plan is charged to your saved payment method by us and auto-renewed each billing period (month or year) until you cancel.
  • Fees and plan prices may change; we'll give notice before a change takes effect for existing subscribers.

6. Payments, escrow, and payouts

When a buyer checks out, payment is collected by us and held in Obramaestra's escrow — it is not paid to the artist immediately. It's released to the artist's available balance once the buyer confirms delivery, or automatically 14 days after the artist marks the order shipped, whichever comes first. Payouts from an artist's available balance to their nominated GCash, Maya, or bank account are issued manually by the Obramaestra team — not instantly on release.

7. Shipping

Shipping is arranged by the artist through a Philippine courier such as J&T Express, JRS Express, LBC Express, Ninja Van or 2GO Express. The fee is calculated at checkout from the artwork's size/weight and the distance between the artist's and buyer's locations, and shown before payment. The buyer pays this fee as a separate line at checkout, on top of the artwork's price, and it goes in full to the artist. Artists are responsible for packaging the work adequately and dispatching it promptly once an order is placed.

The shipping fee shown at checkout is final for the buyer: no further shipping charge is collected after payment. The fee is an estimate from the courier's published rates, the artwork's listed size and weight, and an allowance for packaging. If the courier charges a different amount at drop-off, the difference is the artist's, so artists should list accurate dimensions and weight.

8. Cancellations and refunds

A buyer can request a refund any time before an order is marked complete (i.e. before payment has released to the artist), from the order's page under Purchases. The Obramaestra team reviews each request. Some claims (a piece that never arrived) can be refunded directly by us once approved; others (damaged or not as described) require the buyer to ship the artwork back to the artist first — the buyer pays return shipping and is reimbursed separately, and the refund itself is issued once the artist confirms receipt of the returned piece, not before. Once an order is complete and payment has released, it's final.

9. The AI room-preview tool

Available to artists on a listing they own. It generates a photorealistic preview of that artwork in a described room — the artwork image itself is never altered, cropped, or restyled by the tool, only the space around it. It's a visualization aid, not a substitute for an accurate listing description, and generated previews aren't a representation of the artwork's actual condition or setting.

10. Prohibited conduct

  • Listing anything that isn't an original, one-of-a-kind physical work you have the right to sell.
  • Attempting to complete a sale outside the platform to avoid fees, or otherwise circumventing escrow.
  • Fraud, chargebacks made in bad faith, or providing false payout/identity information.
  • Harassment, hate speech, or abusive behavior toward other users or our team.
  • Attempting to access another user's account or data, or interfering with the platform's normal operation.

11. Verified badge

The verified badge is granted at Obramaestra's sole discretion after a manual review — it is not a right, and we don't guarantee a request will be approved or reviewed within any particular timeframe.

12. Intellectual property

Artists retain all copyright and intellectual property rights in their artwork. Buying a physical piece transfers ownership of that object, not reproduction, display, or any other IP rights, unless separately agreed with the artist in writing. Obramaestra's own name, logo, and software are our property.

13. Suspension and termination

We may suspend or terminate an account that violates these terms, is used fraudulently, or generates a pattern of chargebacks or disputes. Obramaestra is for Filipino artists based in the Philippines and the collectors who buy from them. We may unpublish or remove a profile that doesn't meet that requirement, or that is used mainly to promote an outside website or to place links rather than to show or sell original work. You can delete your own account at any time from Account — see the Privacy Policy for what deletion actually does to your data.

14. Disclaimers

Obramaestra provides the marketplace “as is.” We don't guarantee a listing will sell, verify an artist's representations about a piece beyond what's stated in Section 4, or guarantee the condition of a physical work once it's in transit with the carrier, beyond what escrow and the refund process in Section 8 already cover.

15. Limitation of liability

To the extent permitted by law, Obramaestra's liability to you for any claim arising from your use of the platform is limited to the amount of fees you paid us in the six months before the claim arose. We're not liable for indirect, incidental, or consequential damages.

16. Governing law

These terms are governed by the laws of the Republic of the Philippines, and any dispute not otherwise resolved falls under the jurisdiction of Philippine courts.

17. Changes to these terms

If we change these terms materially, we'll update the date at the top of this page. Continuing to use Obramaestra after a change means you accept the updated terms.
